Financial Services Litigation

Protecting our clients’ interests

The financial services industry is often highly litigious. Our clients rely on our counsel to help avoid litigation whenever possible, but when a dispute becomes unavoidable, to defend our clients’ interests vigorously. We have experience defending banks, mortgage companies and finance companies in disputes with borrowers and insureds. We also have considerable experience in defending financial institutions in class actions or multi-plaintiff mass actions and routinely handle the defense of banks, brokerage firms and issuers of securities in actions brought by bondholders and stockholders. In July of 2007, Burr & Forman LLP was named a “Go-To Law Firm®” for Financial Services Companies by American Lawyer Media.

Our attorneys have representative experience in the following areas:

  • Truth In Lending Act (“TILA”)
  • Home Ownership Equity Protection Act (“HOEPA”)
  • Equal Credit Opportunity Act (“ECOA”)
  • Fair Housing Act (“FHA”)
  • Community Reinvestment Act (“CRA”)
  • Fair Credit Reporting Act (“FCRA”)
  • Racketeer Influenced and Corrupt Organizations Act (“RICO”)
  • Alternative Mortgage Transaction Parity Act (“AMTPA”)
  • Depository Institutions Deregulation and Monetary Control Act of 1980 (“DIDMCA”)
  • Real Estate Settlement Practices Act (“RESPA”)
